I think that is more a problem with individual spells like Charm Person than the mechanic. I mean, at level 6, you can blow all your first level spells on charms and that can get pretty bad. The problem is that now you blow skill points on Diplomacy because no matter how high your points, the DM sets the DC to have the chance of success he likes. Couple things. First, you don't crit if your attack on a natural 20 couldn't hit the guy's AC to begin with.
