Saturday, I was in Troy NY at the "Recovery Sports Grill" at the Hilton where I was staying getting ready to eat my ordered meal when what did my wonderful eyes did see but two spanklingly georgous Labatt Girls promoting the Labatt Blue special for the night. And there I was already having ordered (and drinking) a Bear Naked Ale (American Amber / Red Ale from Adirondack Pub & Brewery in Lake George, NY).

I told them I would be back after the game. (Rensselaer Hockey) They weren't there but the special remained.

Next week they are promoting Labatt Red, just in time for the BIG RED FREEKOUT!

You know it almost makes that four hour drive worth it. (Considering that the Engineers are currently LAST PLACE in division 1 hockey.)

Whole Foods (or as I like to call it, "Whole Paycheck") has chocolate bars with bacon in them.

I actually sprang for the $5 for a tiny, tiny, bar....and was totally unimpressed. But, if some money is burning a hole in your pocket, you can try it at your leisure.

But I'll stick with covering pretzels with chocolate.

I had chocolate covered bacon at a state fair once. It was so salty that that was the more disgusting aspect than eating cold bacon to me. A salt lick bait and switch basically.

I couldn't find the movie thread.

So, I saw Chronicle today, being the chaperone for my little sister and her friends.

Think Akira with Cloverfield's 'documentary' thing, and the gore turned way down.

Some highschoolers find some weird crystal thing that gives them telekinesis. They start off being able to curve baseballs and put legos together, and work up to being able to move cars and fly. One of them goes crazy with the power and keeps getting stronger--well, they all do. But he soon outstrips the others.

Props to the movie for the many and varied uses of fine-controlled telekinesis.

As for the rest...well, it was decent enough that I didn't want my money back. I'd have rather seen the new Men in Black, myself, but it wasn't a waste of time.

Well, we received the results of our house inspection from the rancid whorelandlady.

1. Who actually cleans/checks the fucking window rails? I was only vaguely aware they fucking existed. Fuck, I'm only vaguely aware we have windows.

2. Everywhere else we've ever rented at, house inspections were few and far between, and never a problem. Ditto our friends, including one case where the place was seriously a mess. So I'm not sure this landlady has ever rented to anyone before. Or lives on Earth.

3. Apparently there are scratched floorboards. We can't see them. She took photos, and we still can't see them. So she must have asked the CSI to examine the house, and ZOOM, ENHANCE! etc. At any rate we need to get them sanded and varnished or pay her $3500. Protip: getting it done professionally, while more than we can really afford, is under a hundred dollars. So she can go get a dog up her.

Goddamnit, if we were still in the South, there'd be an easy solution (jokes about murder aside, we know people in SA who do such things as sanding floors).

Or if at least one of us worked full time, we could just tell her to go suck a barrel of cocks, invite her to try to find any new tenants in fucking Narre Warren (protip: the name should say it all) and go to any of the other places begging for tenants, and offering cheaper rates.

NSW fair trading has this excellent guide, which includes a section on "reasonable wear and tear" http://www.fairtrading.nsw.gov.au/pdfs/ ... enants.pdf

Hopefully Victoria will have something similar.
It helps with recommending the oral insertion of a flock of roosters.

Well, my ongoing work termination drama continues. It's a really frustrating and hostile process and there is no employee advocate to help me with the process. I could totally imagine less articulate or bureaucratically inclined persons having a much more daunting experience than I have so far.

My appeal went to a director and in the director's response I was made really upset because they misunderstood many of my points to the point of misquoting me, and were presumably supplied with incorrect or misleading information by my manager. It would be one thing to fire me justly, but this is such buuuuuull. I get that the managers on up want to cover their butts but there seriously should be a higher standard of evidence. I don't know if they are being obtuse through deficiency or intent.

For example:
I stated that a supervisor's office was 50 feet away and able to be summoned if I were really sleeping, and they countered that she had tried to come in to catch people sleeping and never succeeded, and also was too busy to come in (which was not true and she verbally said as much to me) and that she doesn't work weekends... well neither did I! I worked the same exact 4 days a week that she did, every week. I'm going to see if I can get a written statement by my shift supervisor that this it is not true that she could not have been summoned since I'm really hoping it is not something she said but instead was supplied by my bonehead manager without her knowledge. I'm sure it would piss her off almost as much as me that she is being made to sound like she could not have caught someone sleeping at work.

I really hope that at my final hearing where I get to make my case in person to a jury of peers that I will finally get to deal with people intelligent enough to understand that a photo of your eyes closed does not prove that you were sleeping, and that they can agree to my belief that if you are going to fire one of your most exceptional employees it is worth the effort to gather solid evidence.

It will definitely be in my favor that the jurors won't be managers who are mostly worried about how their decision will reflect upon them. I have precious little hope left in this system and sure don't like my prospects at suing for wrongful termination afterward if all continues to go poorly. I don't think I can even sue my accuser for damages due to slander or libel since it appears that it was an anonymous complaint since everyone I've talked to has denied knowledge of who made the accusation.

I've got the contact info of a couple recommended local employment lawyers, but got them too late to help before this process. Hopefully I can get advice in how to conduct my hearing and things I should do in preparation.

I won't get to have my hearing probably for another month. *sigh* This is just so surreal.

Get that lawyer ASAP. It might be too late for your appeal, but they ought to be able to help you prepare for right now.

In Washington, we have a free service called the Unemployment Law Project that mostly advocates for people who have been denied their unemployment benefits after they've lost their job, but if you have a similar organization in your state, I bet you they will give you a referral if the contact info you already have doesn't pan out.

Good luck. When Ess lost his job at Blockbuster a few years ago, we had a similar crazy mess that resulted in his boss quitting. This kind of thing sucks.

You betcha, I am calling him tomorrow. I got the lawyer info a couple days ago and figured I would wait to see what the response was on this current appeal since everything was already in motion.

I'm sure a lawyer would advise me not to post this stuff on a public message board too, but I just need to vent.

It just boggles my mind that nobody in authority even considers how easy it is to take a movie and then screen-grab a frame where someone's eyes are closed. They are so short-handed now that there are monitors that are not being directly watched the entire night. If I was negligent for closing my eyes less than 60 seconds while still being fully awake then management is being negligent on a scale multiple magnitudes worse with their staffing. It makes no sense.

To put things in perspective for how raw a deal I've gotten, the only person previously who ever got fired for sleeping on the job they had months of complaints, they installed a security camera that caught her in the act, and two managers actually came one night and personally caught her as well. Another person was caught sleeping by a director who came in just visiting and she is still employed there. One guy turned off his alarm and missed a fatal event. Someone died. He got 3 days suspension but is now promoted within the department. Two coworkers were suspended for drug use. I am their most decorated technician, never have missed an alarm ever, was responsible for training 7 other techs who all turned out great, I have no black marks on my record and all it takes is a couple liars and couple misleading photos to burn me.

I finished trawling through 1C's secret licensing rules.

1C sells, among other stuff, accounting software with obligatory subscriptions. The rules for licensing those subscriptions are kept secret. So you as a customer can't write to 1C and ask, "I have X machines in Y places running Z copies of software, how many licenses do I need?" - or rather you can, but they'll reply with "we don't know, ask a reseller".

So when the fuckery with accounting software became jailworthy, it got handed to the IT department to be sorted out, and when an illiterate fuck upgraded it from past embezzlement to actual software piracy, the topic was handed over to me, the top question being "how much should we spend per year to be properly covered, $30k or $15k"? Because, you see, the totals various resellers provided fell into that range, despite the fixed cost of an individual part number.

Instead of making a second round of calls to resellers, I googled a noteworthy phrase, found a confidential document uploaded by a careless reseller, read it and calculated the actual cost: $2200. ($2000 if we could afford to buy an extra copy of the subscription to qualify for the 21-40 price bracket, but we're a government institution and no one wants to go to jail for having saved public money.)

The leaked booklet referenced the actual licensing rules, divided for everyone's convenience into ~15000 memos, numbered in ascending order 1, 2, 3, 4, ....., 14755 as of this posting. There's cross-referencing and links to be crawled, but there's no guarantee that every applicable memo is referenced and crawlable.

Also, did I mention that the most important memos are secret? So I went home and downloaded the Not For Retail version of February's issue, all 13 gigabytes of it, to obtain access to maybe 13Mbytes' worth of memos (total). The connection I was stealing got passworded halfway through, but one seeder happened to be in the local network and thus wasn't covered by the ban. Turns out $2200 is correct. I'm looking forward to talking to resellers and quoting the memos at them.

TL:DR: In Capitalist Russia, you need to pirate the software to look at its EULA.

Well, I had my work hearing today, it might be 2 weeks before I hear their decision. I'm kind of hopeful since the managers arguing against me kind of did only a half-hearted effort and openly admitted that they did not have proof that I had slept. They staked their main reason for my termination on the ridiculous claim that someone closing their eyes for a few seconds while remaining in the workroom is far worse than leaving the workroom entirely for 15 minutes. I figure they haven't been thinking about and preparing for this for nearly a month, but even still, they did not make much of a case to my biased eyes. Anywho, I am more hopeful than I have been in a long time, and I have good leads and recommendations for other jobs if my hopes get dashed once more.

I talked with the lawyer and it sounded like my only real cause of action would be to sue the person who made the fraudulent claims against me, and that would be mighty difficult and since she is not a monied individual it would be extra tough to find a decent lawyer willing to attempt it in a manner that would benefit me, and best case I still would not derive enough compensation to make things whole.

I was going to pay for a couple hours of the lawyer's time to go over my opening statement and things I should do at the hearing but it became clear to me that I was going to spend most of that time explaining things rather than receiving helpful advice, so I decided that wasn't really a helpful use of my time or resources (mostly resources, since my time is pretty damned abundant).

After having the same account for almost two decades, I made the swap today from big bank to credit union. I have to wait for a couple of EFTs to clear my bank before I close the account, but my goal is to have the account closed before they can assess next month's fees (the 8th).

The whole process felt surprisingly good. I actually want to do my banking now.

Thanks, Riot. I actually closed my Chase account today because everything's gone through. I took all my money (which wasn't nothing because my tax return came through) and dropped it off in my new account. Instead of paying a monthly fee, my checking account now gains interest!

Ironically, after I closed my account, the Chase alert system sent me a low balance alert eMail to inform me that my balance was $0.00.

I've been using Schwab Bank for my checking for a while. They used to pay nice interest on my checking, but with interest rates being what they are the last few years, it is down to 0.1%. I think it can change daily, but ain't coming back up for a while I imagine to what it was when I first joined up (a full 1% I think). Still, no min balance, and any interest at all with no fees ain't too bad. Only pain is that they have no branches, so I have to mail checks to deposit them.

Still haven't gotten a response back on my hearing verdict. Only a few more days left in their 10 business day deadline... not that I get a prize or anything if they take longer, just extra inconvenience. If they uphold the termination after the incredibly lame performance by my managers at the hearing then I'll know I never had a chance at all and c'est la vie.

I had asked as my remedy to be allowed to be considered an employee but be taking an unpaid discretionary leave of absence in order to continue interviewing in other departments since I really didn't want to go back to working with the sociopath who burned me. However, at the start of my hearing I was told that wasn't something they could grant (nice that I couldn't have been told this a month prior when I first asked).

So instead if they found in my favor they would grant me backpay for all my time off and give me my old job back. The backpay I wasn't asking for, but would be a great help and some compensation for having ruined my chance at the awesome job I was interviewing for. Having my old job back would be well, the job I used to love... but with such bad company. The real scary thing now is if I have to go back and work with the psycho who orchestrated this. I don't know what she will do next. That's what's keeping me up at nights lately. Even if I get good news, I'm still going to have drama like I never imagined or wanted.

I just want a fast-forward button to get this over with.

Yeah...staying at a company after they put you through hell for a badly-timed photo is a raw deal. I mean, was your head even on the desk or was it just you with your eyes closed? Either way, that shit sucks and I hope it works out.



As an end to my Internet Rant Series I have finally achieved closure.

End result: I recently sold my spare washer and drier. Made more money than moocher stole from me and it felt good. I got Chinese food with it, because I ate that to celebrate on the night he left.

The same week I sold it I got a call from Bitch Who Attempted to Steal My Money. BWAtSMM said they were finally going to come back (after ignoring all my calls and shit to try and get them to pay up) to TAKE PICTURES of her washer and drier to try and sell them. You know, while using my place to store them. I did not respond, and laughed heartily about it.

BWAtSMM then called my ladypal (they'd hung out a few times while BWAtSMM was basically living for free with me) and threatened to tell a bunch of her friends bad things about her and report her for a crime she did not commit (stealing mail, when no mail for them had arrived at my apartment ever) if I didn't let them into my apartment. She did this in text, using her own phone.

Saved text, sent reply of "leave me alone forever or I'll report you for extortion." My loose understand of the law says threatening to report people for a crime that was not committed unless they do something is ILLEGAL, I imagine most people would think that. Have not heard anything back from her since (it's been a few weeks), and absolutely nothing has happened. I Guess I was right. I really hope she actually called the cops and said I stole a washer and drier though.

Bitch: "Somebody stole a washer and drier from me!"

Po: "Oh, they broke in?"

Bitch: "No. I left them at his place."

Po: "How do you leave a washer and drier somewhere? When did this happen"

Bitch: "I lived there briefly, and several months ago."

Po: "Why didn't you take them back when you left?"

Bitch: "I was going to sell them while he kept them in his storage."

Po: "Why didn't you report it when it happened?"

Anyways, what a weird fucking coincidence. I got free entertainment, dinner and some spending cash. All in all, the end has been fun but I'm glad it's over. Maybe karma is a thing.
