The first election was were the orange brigade claimed the result was a sham on the morning of voting, having already printed leaflets showing that exit polls gave their guy the win. That being said: both Redshirt and Tussock are being completely retarded about the trial and imprisonment of Tymoshenko. Yulia Tymoshenko was imprisoned during the presidency of Yanukovych, but she was not imprisoned by Yanukovych. She was imprisoned by Yushchenko and his political allies. I know it can be hard to keep all these Ukrainian names straight when they all begin with the letter Y, but they are in fact different people who are not on the same side. Yushchenko is actually the former leader of the party which was reorganized into UDAR, which is one of the factions in the junta today. But a few years ago they were fighting with the Tymoshenko faction so hard that they put her in jail on bullshit charges. Yanukovych is only responsible in the sense that he could have intervened in a dispute between two factions that opposed him and decided not to.

Tymoshenko was a prime minister of the Ukraine, a fact which almost by itself proves that she has embezzled millions if not billions of dollars for herself and her friends. Corruption at the top of Ukrainian government is insanely high by Eastern European standards. Yanukovych got elected in 2010 running a campaign promising to reduce the amount of corruption and embezzlement in the government, a campaign promise he failed to keep. But Tymoshenko wasn't actually arrested for any of that. No one on any side wants the Ukrainian people to see how the sausage gets made, and a full audit of the Ukrainian budget was never a thing that was going to happen.

Tymoshenko was arrested and imprisoned for being a Russian agent. A charge which is laughable and insane and clearly politically motivated. Remember that she is part of the Maidan faction, so being accused of being in bed with Putin is high apostasy for her. But it was former orange revolutionary president Yushchenko, and not Kremlin-leaning president Yanukovych who came to her trial to testify against her.

Ukrainian language law is complex, and there is a web of constitutional law, treties, and national and local laws which protect the rights of Russian speakers and to a lesser extent Tatar speakers. Education and legal proceedings happen in Russian. Maybe Frank assumes that because he lives in a country with an official language that its laws are universally applicable everywhere, and that's why he doesn't need to know almost anything about Ukraine's actual legal system?

I never said the 2012 law, and the failed attempt to repeal it, was "no big deal." I said it had very little practical impact on the way business in that country is conducted. This is true, but it doesn't mean it isn't important--there were brawls on the floor of the parliament when it was passed because the symbolism itself is very important. The Soviets, and the Russian Empire before them, intermittently had policies aimed at erasing indigenous cultures. Even when Russian authorities weren't outright banning the use of native languages in various contexts, the language of power and government was still Russian. As a result, a lot of people in Ukraine see elevating Russian to the status of a state language as a continuation of the bad old days.

The constitution, other national laws, and treaties all guarantee that. Stating that the bill would "allow" that is a mistake. Reporters sometimes get things wrong; they don't have to have an agenda to do that.

Her argument is that Russian should be a state language regionally, and possibly nationally; that the draft law was a cynical wedge issue introduced prior to elections to get the base out; and that Russian is in fact the de-facto language of administration in Russophone areas because regardless of what the constitution says, there isn't any mechanism for enforcement. On the latter issue, the opinion of the Venice commission on the original draft of the law bears this out, as does Kolisnichenko's history of introducing laws purely about elevating Russian's status.

So Yanukovych pushed a law through Parliament that allowed regional governments to declare new official languages for that region based on some demographic criteria, and then shortly thereafter nearly half of Ukraine had made Russian a second official language. Note: enacting this law costs zero fucking money, because it extends a right to regional governments that regional governments previously did not have, and then those regional governments can decide whether or not they want to pay the expense of actually exercising such a right (and, again, fully half of Ukraine decided that was a thing they wanted to do).

Then Yanukovych and his party lost power, and the new Parliament decided that they wanted to repeal the law. As in, they declared openly to the public, "no. Your regional governments should not have the power to pass laws guaranteeing translation of government documents and services to those who speak Russian, no matter how many Russians actually live there." Remember: fucking half of Ukraine's regional governments had just received and exercised that right. So predictably, a lot of people were pissed the fuck off.

And, at the level of the Ukrainian federal government, it did nothing. There is no justification for the repeal you can come up with. Repealing the law has zero benefits to the Ukrainian federal government. It has no purpose, which means it was nothing but a slap in the face to the country's Russian-speaking citizens. The country's many, many Russian-speakers had finally earned equal guarantee of access under the law, and then a bunch of crazy nationalists swept into power and tried to take it away solely for the sake of taking it away!

And that's it. That's the whole story. It was an act of deliberate and willful discrimination with no other purpose, and places with a high concentration of victims started debating whether or not they really wanted to be a part of a Ukraine ran by a government that would spite them for spite's sake.

And because there was so very obviously no compelling reason or justification to do so, the nature of their message was totally transparent: "the current administration wants Russian-speaking Ukrainians to be second-class citizens."

It'd be like Republicans winning big in 2016 and in their inaugural speech being honest about their their intention to spite the African and Hispanic communities because of genuine contempt and political expediency. The nationalists overreached; their wasn't enough bullshit to hide their real agenda behind, and everyone got an open and clear look at them.

I have no prior knowledge, but the arguments here don't really prove Redshirt wrong on the language thing. He claimed that due to various treaties and agreements, Russian was already filling all the practical roles of an official language. That's not really accurate.

Redshirt started by arguing that Russian-speaking Ukranians have nothing to fear because the nationalists can't possibly gather up the political capital to do bad things to them. Meanwhile, in reality land, within days of ousting Yanukovych the Ukranian Parliament voted to repeal the 2012 law. This was (best case) a symbolic act, and the message behind the symbolism was "Russian-speaking Ukranians should go get fucked." That is impressively ominous.

Then Redshirt argued that Russian-speaking Ukranians shouldn't care, because even before the 2012 law that was mostly the status quo anyway. This is stupid, because whether or not it has practical effects it is still true that the Ukranian Parliament voted to tell them to go fuck themself. It is completely understandable that they would not want to be beholden to such an openly hostile Parliament. But also, it is a tautology that the rights of Russian-speaking Ukranians are weakened when you weaken the rights of Russian-speaking Ukranians. Even as a practical matter, this is a step closer to meaningful and harmful discrimination - a door which was closed by the 2012 law was reopened.

The core of the debate is that the Ukranian Parliament successfully voted to flip off ethnic Russians within their borders and Redshirt does not think that is a legitimate cause for concern.

False. This right was already guaranteed under extant Ukrainian law, and in some cases it provided better protection, because it wasn't directly tied to a particular threshold--for instance, the civil procedure code passed in 2005 stipulates that any person entering pleas, testifying, or making statements at trial may do so in their native language. There is no requirement that their language have the status of "regional language." For say, my wife's uncle who lives in Donetsk, this is a stronger protection, since his native language is Georgian.

Seriously, work your way through the relevant law before you make sweeping pronouncements. For instance, here's part of the law on court proceedings from 1989:

Legal proceedings in the Ukrainian SSR are conducted in Ukrainian. In cases stipulated in the second section of Article 3 of the Law, legal proceedings may be conducted in the national language of the majority of the population of a given locality, or in cases stipulated in the thirds section of this article, by a language acceptable to the population of the given locality.

Judicial proceedings in Ukraine in civil, commercial, administrative and criminal cases shall be conducted in the state language. At the territory where (a) regional language(s) is/are used, which conforms to the requirements of section three of Article 8 of this Law, when agreed between the parties, judicial proceedings can be conducted in the given regional language(s).

Now, up until 2012, the 1989 law was the only comprehensive law on language specifically, but sections of it were superseded in various places by later legislation. On the conduct of trials specifically, laws passed in 2002 and 2005 either clarified or superseded that law with more definitive language that both reduced and expanded the rights of non-Ukrainian speakers. There's a lot to it, and if you can get a hold of it, there's a book titled "Language Policy and Language Situation in Ukraine" that's a good place to start. Anyway, your understanding of Ukraine's legal situation is really shallow, and seems mostly based on how you assume law prior to 2012 would work, rather than how it actually does, either in statute or in practice.

What's more, the 2012 law doesn't necessarily make the hard-and-fast guarantees you're claiming it does, either. This could be a problem of translation, but there's a lot of "may" when there should be "shall". For instance, in Article 11:

2. The state shall guarantee provision of services to the visitors of the state and local self-government bodies in the state language and, at the territory where (a) regional language(s) is/are used, which conforms to the requirements of section three of Article 8 of this Law, this/these regional language(s) may be used. The requirement to exercise this guarantee shall be taken into account during recruitment of professional staff.

5. Texts of official announcements shall be drawn up in the state language. At the territory where (a) regional language(s) is/are used, which conforms to the requirements of section three of Article 8 of this Law, the local council may take a decision to permit dissemination of such texts translated into the regional or Russian languages."

There are a lot of other places where that sort of language is used. Like I said, this could be a translation issue, but I don't think so--the people who put together this translation were submitting it for scrutiny by foreign legal experts to determine its compliance with Ukraine's treaty obligations, and they don't seem to use "may" and "shall" interchangeably. I'm also not a lawyer, so I could be incorrect in assuming the distinction is important. Seeing as one of Riabchuk's principle objections was that the law was not going to actually bind governments to be responsive to their citizens linguistic needs, at least one native observer had a similar reading.

That is not quite what I said. I said that there was not a credible threat of mobs of Ukrainian nationalists burning and pillaging their way through Crimea, because there fucking wasn't. Frank was arguing that there was a credible threat of precisely that, because look, there was a failed attempt to delegalize the use of Russian in courts. The second half of this argument was straight-up false--repealing the 2012 law on languages would have been a bad thing, and, as you put it, trying to was "a slap in the face", but it never amounted to a delegalization of Russian in courts.

Ethnic cleansing is a very specific threat, quite separate from vaguely-defined "bad things", and getting the political capital to do it is hard. The extreme right-wing--Svoboda and Right Sector--does not have that capital.

That means that the state or a Ukrainian speaker taking you to court can just "Nope" whenever they fucking feel like and force you to conduct your court business in Ukrainian or GTFO. That's hugely disempowering.

Quoting tiny snippets of laws out of context is no way to conduct an internet argument, but you could have at least bothered to quote a section of the law that didn't leave open a giant "Fuck you Russian speakers" clause that could be invoked at any time. I'm sure there are a lot of them.
