Thing is, if you're talking 3.5 there everyone has high Con. And some even have low Str to go with it (see: Most rogues, all non gish casters).

Minimum is 1 per HD anyways. Even if you got a 4, it would have made no difference. Lucky for you the DM didn't realize enemies can calmly saunter around them. Or you had real defenses.
